Terms of service

Acceptance

By using Mockingjay you agree to these terms and our privacy policy. If you’re accepting for a company, you confirm you have authority to bind it. If you don’t agree, don’t use the service.

Key terms

• ServiceThe Mockingjay platform, automated scanners, and expert penetration testing services.
• SubscriptionThe plan, scope and fees set out in your order form or statement of work.
• Your DataInformation you provide or that we generate for you, including scope, findings and reports.
• TargetsThe systems, applications, networks, cloud accounts and AI features you put in scope.

Authorisation to test

Testing systems without permission can be illegal. Before any scan or engagement starts, you confirm that:

• You have authorityYou own every Target, or have written permission from its owner to have it tested.
• Third parties allow itHosting, cloud and SaaS providers’ policies permit the testing, or you’ve obtained their approval.
• Scope is accurateThe Targets, testing windows and rules of engagement you approve are complete and correct.

Subscription and fees

Fees are billed in advance on the schedule in your order form, plus any applicable taxes and bank charges. Subscriptions renew automatically each billing cycle until cancelled. Pentest engagements are billed as set out in their statement of work.

Your responsibilities

• Keep access secureProtect your login credentials and tell us promptly about any unauthorised use.
• Prepare your environmentBack up systems in scope and provide test accounts and contacts we need.
• Use it lawfullyDon’t reverse engineer the platform, resell access, upload malicious files or test anything outside your approved scope.

Ownership

You keep all rights to Your Data and grant us a licence to use, store and process it only to provide the service. Reports we deliver are yours to use internally and share with auditors, customers and partners. Mockingjay owns the platform, scanners, methods and tooling.

Confidentiality

Findings, reports and everything we learn about your systems are confidential. We share them only with people who need them to deliver the service, under equivalent obligations.

No guarantee of completeness

We test carefully and to recognised methodologies, but no assessment can find every vulnerability. The service is provided “as is”, without warranties of any kind beyond those in your order form. You remain responsible for deciding how to act on our findings.

Limitation of liability

Our total liability is limited to the fees you paid in the 12 months before the claim. Neither party is liable for indirect or consequential losses, including lost profits, revenue or data.

Indemnity

You’ll cover our costs and losses arising from your breach of these terms, including testing we performed in good faith on Targets you weren’t authorised to put in scope.

Term and termination

These terms apply until your subscription ends. We may suspend or end the service if you breach these terms and don’t fix it within 7 days, or immediately for a breach that can’t be fixed or that exposes us to legal liability. If we suspend the service for more than 14 days for reasons of our own, we’ll refund the affected period.

Third-party services

Integrations with tools like Jira, GitHub or Slack are governed by those providers’ terms. We aren’t responsible for third-party services you choose to connect.

Changes to these terms

We’ll email you before any material change takes effect. Continuing to use the service afterwards means you accept the updated terms.

Governing law

These terms are governed by the laws of Singapore. Together with your order form and our privacy policy, they are the entire agreement between us.
